Victory in court today
Superior Court Judge Cynthia Freeland granted a temporary restraining order today against the state. The order prohibits the state from:
Applying or enforcing the January 2021 Framework (ie. 4 ft. spacing, stable groups, etc.)
Applying or enforcing anything similar that includes the provisions of the January 2021 Framework.
Applying and enforcing the terms of their recent denials/conditional approval responses to the Safety Review requests.
The court also ordered the defendant school districts (which include Poway USD) to:
Reopen for in-person instruction "to the greatest extent possible at the earliest practicable time.”
The orders issued today are temporary pending a full hearing scheduled for March 30th.
Superintendent Phelps promptly emailed PUSD families to announce that this court decision will allow the district to proceed with the A/B two days per week concurrent model at middle and high schools starting March 22nd.
We have reached out to PUSD officials to ask how parents might support further action to continue expanding in-person instruction under this decision and how we can assist PUSD in preparation for the March 30th hearing. *Stay tuned for guidance as we learn more.*
